The Board of Directors (“Board”) of Harris County Municipal Utility District No. 105 (“District”) met at 1825 North Mason Rd., Katy, Texas 77449 on October 15, 2018 in accordance with the duly posted notice of said meeting, with a quorum of Directors present, as follows:

Also present were Kristen Scott, Jeff Vogler, Ryan Vogler, Adam Kupstas, Lynnette Tujague, Greg Dubiel, Brian Krueger and G. Taylor Goodall, Jr.

The President called the meeting to order and declared it open for such business as might properly come before it.

  1. The Board considered and approved the Consent Agenda. After review and discussion, upon motion duly made and seconded, the Board unanimously approved Consent Agenda as presented.
  2. The Board considered public comments and a law enforcement report. After seeing no public comments, the President continued with the Agenda.
  3. The Board considered the ratification of a Resolution Adopting the Operating Budget for Fiscal Year Ending September 30, 2019. After a brief review and discussion, upon motion duly made and seconded, the Board unanimously approved the ratification of the Resolution Adopting the Operating Budget Fiscal Year Ending September 30, 2019 as presented.
  4. Mr. Goodall reported on the status of the Defined Area election and it was noted that a special meeting to approve an Order Canvassing the Results of the Election shall be held at 6:30 p.m. on Monday, November 11, 2018.
  5. Jeff Vogler and Ryan Vogler presented an engineer’s report and updated the Board on the status of the elevated storage tank waiver application as well as the surface water conversion project. The Board considered bids for the WS&D improvements for the West Little York and Westgreen extension and upon recommendation, the Board approved awarding the bid to Fellers & Clark in the amount of $1,809,000, contingent on final plan approval. An Interlocal agreement for a storm sewer siphon between the District and Harris County will be necessary and shall be approved at the District’s  November Board of Directors meeting. Mr. Vogler then updated the Board on the Jasmine Heights and Lantana developments, as well as the status of the wastewater treatment facility. The Board then reviewed the status of a request to serve a senior living facility with Mr. Vogler. Upon motion duly made and seconded, the Board unanimously approved Mr. Vogler’s report as presented and authorized the action items contained therein.
  6. The Board considered developer reports. Adam Kupstas reported that Jasmine Heights development continues. Greg Sissel approached the Board and presented an Agreed-Upon Procedures Report for developer reimbursement from the Series 2018 Bond Issue. The Board unanimously approved the report as presented and authorized the disbursement of funds to the developer in a manner consistent therewith upon closing of the Series 2018 Bond
  7. The Board then confirmed the publication of notice of the District’s intent to hold a public hearing and set the 2018 tax rate at this meeting. Accordingly, the Board opened a public hearing on the District’s proposed 2018 tax rate and then discussed the tax rate. It was moved, seconded and unanimously carried that there be passed and adopted the attached Order accepting the final appraisal roll and setting a maintenance and operations rate of $0.20 per $100 in taxable valuation and a debt service tax rate of $0.60 per $100 in taxable valuation. The Board then executed the amendment to the District’s information form to reflect the tax rate, and the attorney was directed to file copies as required by law.
